Other or additional terms or conditions that conflict or contradict this agreement in any purchase order, document, or other communication ("order"), prepended terms and conditions on any customer document (for example, purchase orders or confirmations), and/or Texas Native’s failure.

Prices are FOB Texas Native's facility (as defined by the Uniform Commercial Code), and unless otherwise stated on the front of a Texas Native invoice or acknowledgment, terms of payment are net 30 days from the invoice date. Prices are subject to timely payment, and any past-due balance will accrue interest at the monthly rate of 1.5 percent. Texas Native maintains the right to change the terms before shipping, demand upfront payment, delay or cancel any shipments or orders owing to the client's creditworthiness, or if the customer doesn't pay their bills on time.

We may offer terms to approved consumers and take the majority of major credit cards, cash on delivery, Paypal, and wire transfers for payment. Customers from abroad must use Paypal or a wire transfer to make their payments. Before placing an order, you must submit a Request for Quote or contact our Sales Department to verify availability and pricing.

In the absence of prior shipping arrangements, We may choose a carrier. When products are delivered to the carrier, the customer, or the customer's agent (including, without limitation, any test house or value-added service provider), whichever occurs first, our liability for any loss or damage ends, and title passes. If Texas Native keeps merchandise at the customer's request while waiting for instructions or to reschedule a delivery, the customer is responsible for paying storage fees.

The terms, conditions, and limitations of the manufacturer's standard warranty apply to all products sold by Texas Native, as well as the parts and materials used in any assembled or customized products. This warranty expressly supersedes all other warranties, express or implied, made by or on behalf of Texas Native or the manufacturer. Customers' sole and exclusive recourse under these warranties are restricted to Texas Native’s choice of (a) refunding their purchase money, (b) having any defective products fixed by Texas Native, or (c ) replacing the defective product. Except as expressly stated or particularly referred to in this paragraph, the Customer agrees.

The condition or performance of any products, their merchantability or fitness for a particular purpose, or anything else, are not guaranteed by Texas Native systems or anyone else, either expressly or impliedly (including, without limitation, in advertising materials, brochures, or other descriptive literature). When it comes to the performance or suitability of any design or specification submitted to Texas Native by or on behalf of the customer, Texas Native assumes absolutely no duty or liability.

The use of the customer's part number on any document or on any product is just for convenience and does not imply that Texas Native is making any claims about the functionality, specifications, or suitability of any part for any particular use.
